The federal recidivism problem has a dollar amount

First Step Act compliance isn't just a legal obligation — it's the most cost-effective way to reduce the federal prison population long-term.

44%

of federal prisoners are re-arrested within 8 years of release

$42K

average annual federal incarceration cost per person (BOP)

153K+

people in federal custody — the largest prison system in the US

FSA

mandates evidence-based recidivism reduction programs — and requires tracking participation

The First Step Act (P.L. 115-391) requires BOP to assess all prisoners using a validated risk and needs assessment tool (PATTERN), assign Evidence-Based Recidivism Reduction (EBRR) programs, and track completion. Education and vocational training are explicitly listed as qualifying EBRR activities.

How OpenPath satisfies First Step Act & PATTERN requirements

Two of the biggest mandates from FSA — PATTERN scoring and EBRR programming — are directly addressed by OpenPath.

PATTERN Score Reduction

Education participation directly lowers PATTERN risk scores

PATTERN (Prisoner Assessment Tool Targeting Estimated Risk and Needs) calculates risk of recidivism and determines early release eligibility. Educational programming is a scored factor — active participation in accredited courses lowers an individual's risk classification.

Lower PATTERN scores qualify individuals for:

  • Increased good time credits (up to 54 days/year under FSA)
  • Earlier placement in Residential Reentry Centers (halfway houses)
  • Home confinement eligibility
  • Priority consideration for compassionate release

First Step Act — EBRR Programs

OpenPath qualifies as an Evidence-Based Recidivism Reduction program

The First Step Act requires BOP to provide EBRR programming matched to each individual's assessed needs. Education and vocational training are explicitly named qualifying program types in the statute (34 U.S.C. § 60541).

OpenPath satisfies FSA EBRR requirements by delivering:

  • Documented course completion with verifiable certificates
  • Career-aligned vocational training (OSHA, CDL, IT, trades)
  • Exportable participation reports for BOP records
  • Pre-release employment pipeline to fair-chance employers
  • SORNA-aware job matching to set realistic post-release expectations

Pell Grant Alignment: The Consolidated Appropriations Act (2021) restored Pell Grant eligibility for incarcerated individuals. OpenPath's course catalog includes providers that partner with Pell-eligible institutions, supporting Second Chance Pell implementation.

Works with your existing infrastructure.
No hardware purchase required.

Federal facilities operate under strict procurement constraints. OpenPath is designed to run on what you already have — no RFP, no capital budget, no IT overhaul.

Work Opportunity Tax Credit (WOTC)

Employers hiring your released population can earn $2,400–$9,600 per hire

When individuals released from your facility are hired through OpenPath's employer network, those employers can claim the federal Work Opportunity Tax Credit (WOTC) — up to $9,600 per qualified hire. Federal convictions are a qualifying category.

This is a direct federal financial incentive encouraging employers to hire your released population. OpenPath's employer portal includes a built-in WOTC calculator and IRS filing guidance.
